PLEASE READ THIS DOCUMENT CAREFULLY AND IN ITS ENTIRETY

1. Please read carefully. Payment by personal check, travelers check, cash, money order, debit or credit card will indicate that you have read, understood and agreed to the Adventures In Fitness.Biz terms and conditions (hereinafter collectively referred to as "AIF.Biz"),
2. Participant agrees to the use of his/her likeness for AIF.Biz' sales and marketing. AIF.Biz and its Affiliates, retain the rights to all images taken at events.
3. AIF.Biz reserves the right to prohibit the participation of any person whose conduct has been shown to be offensive to any member or to the reputation of AIF.Biz. You will be charged the full price for the event you attended (fully or partially) and prohibited from participating in future AIF.Biz events/retreats.

Reservation & Cancellation Policy

Reservations:

• A 25% deposit is required at the time a reservation is made.
• The remaining balance is due by the payment deadline. Balances not received by the payment deadline, will be subject to a cancellation of your reservation and forfeiture of your deposit.
• All reservations are subject to the approval of Adventures In Fitness.Biz .

Cancellations:

• All cancellations are subject to a cancellation fee of $180.00.
• Prior to payment deadline: Cancellations made before balance is paid are subject to a cancellation fee of $180.00.
• Cancellations made after the payment deadline, but 30 days prior to the retreat date are subject to a cancellation fee equal to 50% of the retreat cost. If your spot can be filled you will receive a refund, minus a $180.00 cancellation fee.
• Cancellations made 29 to 14 prior to the retreat date are subject to a cancellation fee equal to 75% of the retreat cost. If your spot can be filled, you will receive a refund, minus a $180.00 cancellation fee.
• Cancellations made less then 14 days prior to the retreat date are subject to a cancellation fee equal to 100% of the retreat cost.
• If you no show on the day of the retreat, your reservation is cancelled and you are subject to a cancellation fee equal to 100% of the retreat cost.
• In the event a retreat is cancelled, all participants will receive a refund within 14 days of being notified of the retreat cancellation. All participants who made payment by credit card, debit card or online check, will receive a refund minus any online processing fees; All participants who made payment by personal check, traveler's check, cash or money order will receive a full refund.
• Please note that injury or illness will not exempt you from the cancellation policy. We reserve the right to cancel any retreat with prior notice and will not be responsible for additional travel costs incurred. We strongly recommend that you consider obtaining trip insurance to cover any unforeseen trip cancellations, medical or family emergencies.

Smoking

• Our retreats have a no smoking policy.

Activities

• Any activities which can result in damage of your living quarters or interfere with the peaceful enjoyment of other residents, is prohibited.

Lost or stolen items

• Neither Adventures In Fitness.Biz nor the property owners will be held responsible for any items discovered missing during a guests stay. Please secure all personal items, at all times.

Limit of Liability Participant Agreement, Release, and Acknowledgement of Risk:

In consideration of the services of AIF.Biz, their agents, owners, officers, volunteers, participants, employees, contractors and all other persons or entities acting in any capacity on their behalf, I hereby agree to release, indemnify, and discharge AIF.Biz, on behalf of myself, my heirs, assigns, personal representatives and estate as follows:

1. I acknowledge that "adventure activities" such as bicycling, hiking, obstacle courses, relays, kayaking, climbing, running etc., entails known and unanticipated risks, which could result in physical or emotional injury, paralysis, death, or damage to me, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. I also acknowledge that AIF.Biz and its affiliates are not responsible for any losses, injuries or damages I may suffer, relating to participation in any AIF.Biz events/retreats. The risks include, among other things: falling, collision, upset, striking obstructions or other person, unsafe speed of travel for conditions, head injuries, equipment failure, and weather conditions including temperature exposure (hypothermia, sunstroke, sunburn, and heat exhaustion), dehydration, and highway or roadway vehicles.
2. I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary and I elect to participate in AIF.Biz events/retreats and assume the risks inherent in all events/ retreats.
3. I hereby voluntarily release, discharge, and agree to hold harmless AIF.Biz from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of AIF.Biz or anyone acting on their behalf, any equipment and or facilities used, including any such claims which allege negligent acts or omissions of AIF.Biz.
4. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating in the events or I agree to bear the costs of such injury or damage myself. I further certify that I have no medical or physical conditions which may interfere with my safety in any event, or else I am willing to assume -- and bear the costs of -- all risks that may be created, directly or indirectly, by any such condition whether pre-existing or not.
5. In the event that I file a lawsuit against AIF.Biz, I agree to do so solely in the state of California, and I further agree that only California State law shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portion; shall remain in full force and effect.
6. Should AIF.Biz or anyone acting on their behalf be required to incur attorney's fees and costs I agree to hold AIF.Biz harmless for all such fees and costs.

By my personal check, money order, cash, credit card, travelers check, debit or card payment, I acknowledge that if anyone is hurt or property is damaged during my participation in these activities, I may be found by a court of law to have waived my right to maintain a lawsuit against AIF.Biz on the basis of any claim from which I have released them herein. I have read this entire document. I have understood this document, and I agree to be bound by its terms. The submission of my personal/travelers' check, cash, money order or credit/debit card, payment will indicate my agreement to these terms and AIF. Biz' Limit of Liability.
